Description: On September 2, 2015, at about 2 PM, Plaintiff Marija Filipovic was in swimming attire in the swimming pool area of McCarren Park in Brooklyn. When plaintiff was in the pool, defendant officer Torres told Plaintiff she had to leave the pool because they were understaffed. Plaintiff mentioned to the officer that there were other lifeguards present and that there weren't many people swimming, but the officer still demanded plaintiff leave the pool, so she exited. As she exited the pool, Officer Torres aggressively grabbed plaintiff by the arm and pulled her toward the exit. Plaintiff stated that she was planning to leave and that he did not need to pull her.
