Description: On September 20, 2011 at about 10:00 am, plaintiff Eric Gersbacher was sitting on a blue tarp in Zucotti Park in lower Manhattan as part of the Occupy Wall Street protests when he was ordered to move by NYPD Deputy Inspector Edward Winski. An unnamed NYPD officer grabbed at plaintiff's shirt without prior warning, and plaintiff then complied with Deputy Inspector Winski's order and began to walk away from unnamed NYPD officers. One or more of the officers then grabbed plaintiff, picked him up, carried plaintiff over the tarp on which he had been sitting, and then dropped forced plaintiff's face into the ground beside it.
