Description: On January 7, 2022, Plaintiff was present at 254 West 35th St, NY, NY, sitting in the driver’s seat of a vehicle taking a nap while his wife was shopping nearby. Plaintiff’s family friend unexpectedly approached the car and asked for a ride home. Thirty minutes after Plaintiff’s family friend, a minor, entered the car, Defendants approached the car. In response to Defendant’s demands, Plaintiff unlocked the car door. Defendants opened the vehicle’s driver’s side door, grabbed Plaintiff, and forcibly pulled him out of the vehicle, grabbing his arms and choking him.
