Description: On April 20, 2012, Plaintiff Peak was lawfully present on a street in New York City, when several unidentified NYPD officers, as well as NYPD officer Jonathan Goenner, handcuffed and arrested Peak, allegedly without probable cause. The complaint alleges that Peak was subsequently incarcerated on Rikers Island while the aforementioned NYPD officers initiated criminal proceedings against him, allegedly with knowledge that they lacked probable cause. On August 24, all criminal charges against Peak were dismissed.
