Description: On October 1, 2017 at approximately 12:00 a.m., Plaintiff Francisco Padilla was unlawfully searched, touched, seized with excessive force, and detained by the defendants, the City of New York, the New York City Police Department, NYPD Officer Teresa Toro, NYPD Officer Gina Mestre, and unnamed NYPD officers John Doe and John Roe. On this date and time, the plaintiff was lawfully in the vicinity of West 192nd Street and Jerome Avenue in the Bronx when he was approached, searched, and detained by the defendants without probable cause or an arrest warrant. Rather, the defendants stopped and questioned the plaintiff based on solely on his age and/or race.
