Description: On September 17, 2013, Plaintiff was walking to the subway when he stopped at Zuccotti park to read the signs of protestors. Plaintiff began speaking pleasantly with one of the protestors when PO Ernst approached and told Plaintiff to keep walking. Plaintiff told PO Ernst he was interested in the protestor's views and asked why he had to move along. They proceeded to go back and forth with Plaintiff saying there's no traffic on the sidewalk, he's not obstructing pedestrian traffic, and he's a citizen who had a right to hear what the protestor was saying.
