Description: On January 27, 2020, Plaintiffs were dining in a restaurant when Plaintiff Mr. Shaw was falsely arrested without probable cause after NYPD Officers attributed the report of a fourteen year old boy who had indicated that a man wearing a red scarf had approached him in the men's room at the restaurant and touched his buttocks to Plaintiff Mr. Shaw. Defendants coerced the victim to identify Plaintiff Mr. Shaw as the perpetrator and brought Plaintiff to the police station. Defendants did not conduct any investigation such as viewing surveillance tapes, talking to witness, or surveying other patrons for a red scarf. Plaintiff was charged on January 28, 2018.
