Description: On May 29, 2014, plaintiff was lawfully in the Baruch apartments at 60 Columbia Street, New York, New York. Defendant police officer Phillip Grella and other defendant NYPD officers searched and questioned plaintiff about contraband. Police handcuffed the plaintiff's hands behind his back despite his informing the officers that he had a dislocated shoulder. After remaining in that position for 30 minutes the defendants walked plaintiff to a van, pushed his arms to get him into the van and worsened his injury. As a result, plaintiff suffered herniation, bruising and swelling of his previously dislocated shoulder.
