The responding NYPD officers, including Daniel Wynne, Justin Garcia, Pedro Lopez, and Aaliyah Card, escalated the situation, even though no criminal matter was involved. Officer Wynne falsely broadcasted that Plaintiff was armed and involved in a murder, leading to the officers using excessive force. Plaintiff was physically restrained, assaulted, and his pre-existing shoulder injury was aggravated, resulting in a dislocation that required surgery. North on Broadway through SoHo after attending a Black Lives Matter Protest. Mr. Cruz and Ms. Tavarez passed a drug store on Broadway and 4th Street with a broken front glass door.
