Description: Plaintiff was outside a convenience store when he approached by plain clothed PDPS Peace Officers, defendants Figeroa and others. Defendant Figeroa swung at the plaintiff and chased him around the street. Plaintiff went to the PDPS to report the assault and requested that the head of PDPS obtain and view the surveillance video of the assault. The plaintiff was told that such video did not exist. PDPS Peace Officer Bushrod then arrested the plaintiff and took him to the 43rd precinct where he was charged with assault in the third degree, menacing, menacing in the second degree, and harassment in the second degree. These charges were later dismissed by the DA.
