Description: On August 11, 2022, Plaintiff Mrs. Smith was verbally attacked by Defendant K. Bernard, a private citizen, and subsequently called 911. NYPD Officer Carla Guevara and their partner arrived at the scene but did not arrest Defendant K. Bernard, despite being told that K. Bernard had assaulted her with a basketball earlier in the week. A few hours later, Plaintiff Mr. Smith arrived home and was approached by K. Bernard, who verbally attacked Plaintiffs and then physically attacked Mr. Smith. Description: On August 11, 2022 at approximately 9:00 p.m., in the vicinity of 4048 Seton Avenue, County of Bronx, City of State of New York, Plaintiffs were illegally stopped, seized and searched, battered and assaulted, detained, and arrested, by and/or at the direction of NYPD defendants, including GUEVARA, and JOHN OR JANE DOE 1-10. This followed after Plaintiff Mrs. Smith was verbally attacked by her neighbor who used inappropriate profane language. Defendants conducted a police investigation, generated a complaint report, but failed to arrest Plaintiff Mrs. Smith’s neighbor for committing a criminal offense, then left the vicinity.
