Description: On May 16, 2020, at approximately 10:00 p.m., Plaintiff, Mr. Damien Guarniere was in the vicinity of 1633 Second Avenue, New York, New York. Mr. Guarniere had not committed any crimes or violations of the law and had not been accused of such by any identified civilian witnesses. At said date, time and place, Mr. Guarniere began to lawfully record the activities of various NYPD police officers, including Defendant Officers Osmairy Castillo, Christian Campos, Tyler Barbour, Richard Hornberger and Kathleen Walsh, with his cellular phone.
