Description: On October 7, 2015, the plaintiff was lawfully walking on the sidewalk on Third Avenue between 104th and 105th Street in New York County, when the plaintiff saw money on the sidewalk floor and picked it up and placed it in her bag. Immediately after she picked up the money, defendant NYPD officers detained the plaintiff and charged her with petty larceny. The plaintiff was taken to 23rd Precinct, strip searched and held in a cell. As a result of the arrest the plaintiff was fired by her employer and thus sustained a loss of earnings.
