Description: On September 18, 2014, the plaintiff was lawfully on a sidewalk in the Bronx when NYPD Officer Evan Lavin searched the plaintiff and told the plaintiff that he was free to go. The plaintiff left the area. However, after the plaintiff later returned to the same sidewalk, Officer Lavin and Lieutenant Mahoney unlawfully stopped, frisked, and searched the plaintiff in a demeaning manner in front of the public. They then placed the plaintiff under arrest, putting excessively tight handcuffs on the plaintiff's wrists, and held him at the 52nd Precinct, accusing him of possessing contraband that was never actually found on the plaintiff.
