Description: On March 18, 2017 at approximately 6:00 pm, while at a gathering in Astoria, Queens and subsequent to having attended a funeral, Plaintiff Arvell Rollins consumed a few drinks causing him to become intoxicated. Subsequently, at approximately 9:00 pm, Plaintiff left the residence with another male individual, who drove the two men to burger king. The vehicle belonged to Plaintiff. The Burger King was located at 21st street and Broadway in Astoria, Queens. The vehicle was parked in the parking lot of Burger King. They both entered burger king however Plaintiff proceeded to the restroom as the male friend entered the food line.
