Description: On October 26, 2021, defendants searched plaintiff's residence at 1350 Fifth Ave, Apt 3B, NY, NY, and recovered a loaded firearm, ammunition, and narcotics, from inside a locked room that did not belong to plaintiff and which plaintiff had no access. Defendants arrested plaintiff for possession of same. Defendants informed the New York DA there was evidence establishing plaintiff’s control over the contraband. Defendants handcuffed plaintiff and transported him to the 28th Precinct. On October 26, 2021, Plaintiff was arraigned and bail was set in the amount of $150,000. Description: In response to a concerned call from the Plaintiff's mother, two or three male officers - including Defendant Evans - arrived outside the Plaintiff's building just as the Plaintiff was exiting. After the Plaintiff tried to peacefully walk through the officers, who were intentionally blocking his path, Plaintiff was rear-handcuffed and violently thrown to the ground and stepped on by Defendant Evans. The Defendants than put the Plaintiff into an ambulance and rode with him to the hospital. Despite complaints from the Plaintiff, the Defendants did not adjust the excessively tight handcuffs until they arrived at the hospital.
