Description: On May 30, 2020, at approximately 7:00 p.m, in the vicinity of 24th Street and 7th Avenue, Manhattan, New York, Plaintiff was lawfully observing a peaceful protest at Union Square Park where he was standing in an area where the Defendant Police Officers Hernandez, Pertrigno and Joh Does began to arrest the entire crowd. Plaintiff was standing on the sidewalk taking photographs and videos of the protest when Defendants then grabbed, handcuffed, and arrested the plaintiff without legal justification or excuse. The plaintiff was then transported to 1 Police Plaza and later to the Central Booking where he was confined to a holding cell for approximately 6 hours. Description: On or about May 31st, 2020, Plaintiff was lawfully present at a protest at the Barclay's Center when he was unlawfully stopped, searched and detained by PO Cristian Hernandez and PO Urbanek Yandeiry. PO Hernandez and PO Yandeiry forcibly shoved Plaintiff to the ground, punched him, and slammed him into the pavement. They then affixed tight handcuffs to Plaintiff's wrists. Plaintiff was then transported to One Police Plaza where he was detained for six hours until given a Desk Appearance Ticket and allowed to leave. Plaintiff then sought out medical attention for his physical and psychological injuries at St. Barnabas Hospital. All criminal charges against Plaintiff were dropped on October 9th, 2020.
