Description: On December 19, 2012, at approximately 12:30 a.m., Plaintiff was unlawfully stopped and searched by NYPD officers, including officers David Comens, Luis Perez, and Nigel Fenton, at the Saratoga Avenue Subway station in Brooklyn.
Plaintiff had swiped his Metrocard, and was running to catch the train when the officers stopped plaintiff with no reasonable suspicion, aggressively and repeatedly searched him, which yielded no contraband. They falsely arrested him, and took him to the 73rd Precinct. The officers prepared false paperwork, including an
arrest report, and forwarded it to prosecutors. All charges were eventually dismissed.
