(Henisha Toppin’s 10-year-old son), were subjected to false arrest, false imprisonment and detention, illegal taking of property, loss of parental rights, assault and battery and use of excessive force, for acts of which plaintiffs were innocent. On the incident date, Plaintiffs were having a New Year’s Eve celebration at Toppin’s mother’s home in Brooklyn. Description: On or about December 12, 2019, Plaintiff []. Plaintiff was approaching 54th Street and 5th Avenue, where he intended to turn left onto 5th Avenue, when he was stopped by Officer Larregui at the intersection of 54th Street and 5th Avenue. Officer Larregui demanded Plaintiff's license and registration, and five seconds later attempted to open Plaintiff's locked door. Approximately four seconds after that, Plaintiff gave Officer Larregui his license and registration, at which point Officer Larregui instructed him to put the car in park, reached into Plaintiff's car through the driver's side window, and pushed Plaintiff's left shoulder backwards.
