Description: The defendants arrested the plaintiff in the vicinity of his home and charged with criminal possession of a weapon in the fourth degree and criminal mischief in the fourth degree. Before the arrest, the plaintiff called 911 because his ex-girlfriend cut the power cord to his television. When the defendant officers examined the television, they informed the plaintiff that the television was approx. 19-inches too small for police involvement. The plaintiff was then arrested and taken to the 73 precinct while the defendants seized the television without providing a voucher. At the precinct, the plaintiff was unlawfully searched.
