Description: On December 17, 2016, Plaintiff was using the subway in the Bronx with his girlfriend and daughter. Plaintiff used the exit gate to enter the subway platform because he had a stroller. An unnamed Officer approached Plaintiff and accused him of fare evasion. Plaintiff's girlfriend explained to the officer that she had paid the fare for both of them and the Officer failed to check the fare cards to verify use. The Officer arrested Plaintiff for fare evasion and trespass. Plaintiff was incarcerated for 24 hours and his charges were dismissed by the district attorney.

Description: On September 28th, 2012, Plaintiff was at the subway station when he noticed NYPD officers Kelvin Prado and Maria Mendez arresting another individual. He began to videotape the arrest. One of the officers told him he needed to pay his fare or stop recording, so he paid his fare. Nevertheless, the other officer grabbed his camera, then arrested and handcuffed tightly. His video footage was deleted and he was falsely charged.
