Description: On May 30, 2012, Plaintiff was at a deli in Brooklyn buying breakfast when he was involved in a dispute with the owner of the deli and an employee who threw a bottle of ketchup at Plaintiff's head. Plaintiff called the police and Defendant Officer Dispigna and several unnamed defendant officers arrived on scene. Defendant Officers searched the plaintiff and recovered a small pocket knife. Defendants arrested plaintiff and one defendant officer handcuffed him unreasonably tight. Plaintiff complaints about the tight handcuffs were ignored and one defendant told plaintiff to "shut the fuck up" and to stop talking that "guinea shit."
