Description: On January 21, 2016, Plaintiff was taking a train from Chatham New Jersey to Penn. Station in New York, which arrived at 6:15 pm and then proceeded to a subway train. He entered the second car from the front and rode on the train to Time Square where he got out and proceeded towards the S train. Defendant Officer Danoy stopped and arrested Plaintiff and handcuffed him on the belief that he had sexually abused a fellow train passenger. Description: On April 6, 2014, plaintiff, an artist, was giving a performance at the 42nd Street Subway Mezzanine under Times Square when he was approached by defendant Lu, who told plaintiff to cease his performance and to leave the area. Plaintiff responded by asking Lu why he was being told to leave, and cited MTA rules expressly allowing artistic performances on MTA property.
