Description: On September 25, 2012, Plaintiff Charles Mathis was at the intersection of Jerome Ave and East Mount Eden Ave in the Bronx, pushing his daughter on a stroller when Defendant Officer John/Jane Doe bumped into Plaintiff. Plaintiff said "You bumped me." Defendant turned around, asked "what did you say to me?", then struck Plaintiff across the face with a baton. Plaintiff raised his arms to protect himself. Defendant continued to strike Plaintiff with a baton and then tackled him to the ground. As Plaintiff lay on the ground, Defendant Officers kicked, punched, and struck Mr. Mathis.
