Description: On October 23, 2012, plaintiff clocked out from his job as a store clerk at Macy's and was riding the train home from work. P.O.s Anthony Francavilla, Clarice Luces, Sgt. Lee Jones, Bernabe Vargas stepped on the train and asked plaintiff for identification. Plaintiff complied, and the officers took him off the train, placed him against a wall, patted him down, and emptied his pocked. The officers did not tell plaintiff why they were arresting him, but he could decipher based on snippets of radio communication that a young black male in a hoodie had recently committed a crime.
