Description: On May 1, 2012, Plaintiff was lawfully participating in a demonstration. Plaintiff observed Defendant DOE engaged in an altercation with an unknown person. Plaintiff called out loud that someone should get the DOE’s badge number. DOE charged at Plaintiff and began to assault him with his fists and with his baton. Plaintiff was thrown to the ground, where Defendants SERGEANT, PLAINCLOTHES and SUPERVISOR set upon him.
