Description: On August 16, 2021, NYPD Detective DWYER used a photograph of Plaintiff on the Internet in a “Wanted Sign,” stating that she committed grand larceny to remove a Rolex watch and Chase Credit card from a roommate. The plaintiff did not commit any crime and was shocked to see the “Wanted Sign.” Even though it was a fake story, friends and neighbors believed that it was a true story. Detective DWYER confirmed that the picture was correctly described because two victims showed them pictures of her. After that, Detective DWYER reiterated that they conducted an investigation and found a surveillance video from the building, and the female perpetrator did look similar to Plaintiff. Description: On August 18, 2019, Plaintiff Destiny Rivera was at the corner of Broadway and East 12th street when Defendant Detective Michael Simms and Defendant Officer Kevin Dwyer forcibly slammed Plaintiff of the ground. Defendants then handcuffed plaintiff and caused her to be confined and imprisoned in various locations. On that same day, Defendants submitted knowingly false statements against Plaintiff leading to initiation of prosecution against Plaintiff. On February 26, 2020, all criminal charges against Plaintiff were dismissed.
