Description: On May 27, 2019, around 2:00 AM, Plaintiff Roger Smith was in the vicinity of Robert's Men's Shelter at 1068 Franklin Avenue, Bronx, signed in for the nightly count and smoking a cigarette outside before planning to re-enter the shelter, as he had done 2-3 times before. When Plaintiff attempted to re-enter the building and return to his bed, Defendant Shelter/DHS employee Tynishia Stewart, refused him entry, stated he was being transferred shelters, and called the police when Plaintiff attempted to peacefully return to his bed. Defendant Officers Jesus Montesino, Jenny Pacheco, Nikauri Terrerro, Victor Velez, and John and Jane Doe 2-7 arrived on the scene and approached Plaintiff. After Plaintiff explained that...
