Description: On July 7, 2020, Plaintiff was lawfully present when a fight occurred between two unknown individuals. Defendant NYPD Officers John Hernandez, Robert Harrington, Radhames Regalado, and John or Jane Doe 1-10 then illegally approached, stopped, seized, detained, and questioned Plaintiff without probable cause. Plaintiff informed the Defendant Officers that he was a construction worker and carried a box cutter for work in his bag, which he voluntarily handed over to Defendants. Defendants then questioned the unknown individuals in the fight before returning to Plaintiff and accusing him of a criminal offense. Description: On July 7, 2020, police officers John Hernandez (Sheild No. 22889), Robert Harrington (Sheild No. 30008), Radhames Regalado (Sheild No. 15622), and other police officers stopped, questioned, searched, arrested, and detained plaintiff. Plaintiff was a construction worker carrying a bag of box cutters. Plaintiff explained his occupation and items in bag to the officers and voluntarily handled over the bag of box cutters to the officers. However, police officers accused plaintiff of a criminal offense and proceeded to violently contort his arms behind his back so that mental handcuffs could be applied.
