Description: On October 10, 2012 Plaintiff boarded the A-Train Subway when NYPD Officer Defendants Batista and Colangelo approached him and told him to get off. Plaintiff complied and walked off the train and proceeded to walk up the steps of the station. Plaintiff lost his step and fell down 12 steps. Defendants moved out of the way as Plaintiff fell. Plaintiff landed on his chest and was then handcuffed and arrested for two counts of assault in the second degree. Plaintiff was taken to the precinct and held for five hours. Defendants filed false reports of the event to the District Attorney.
