Description: On October 3, 2012, Plaintiff was sitting on the front steps of his residence with family and friends. PO Daniel Cruz and John Zizzo passed through the gated area of the residence and stood before them and began harassing them and demanding to know why they were there and asked for ID. After plaintiff stated he did not have identification and advised that he lived at the location, the officers grabbed Plaintiff, punched him in the face with a closed fist, and then repeatedly sprayed him in the face with pepper spray.
