Description: On September 12, 2014, the owner of Queens Hand Car Wash and Detail reported to police officers of the 108th precinct that fraudulent checks had been drawn from the business's bank account. Detective Delarosa investigated the complaint, and on December 5th, discovered the name, date of birth, social security number, home address, and physical description of the man cashing these checks. While this man shares the name John Henry with the plaintiff, it was clear that they were not the same person. The detective produced an "i-card" with John Henry's personal details and attempted to arrest him in New Jersey, but police were unsuccessful. The case was reassigned to Det. Description: On April 22, 2012, plaintiff spoke with defendant Detective Delarosa over the phone regarding a motor vehicle incident that had taken place roughly two months prior and, as a result of that conversation, went to the 108th Precinct. At the precinct, plaintiff was questioned regarding the incident, detained for approximately two hours and placed under arrest – charged with one count of VTL 600(1)(a), leaving the scene of an incident without reporting – without probable cause. Plaintiff was required to appear in court approximately ten times before the charge was ultimately dismissed on September 12, 2013.
