Description: On November 8, 2014 at approximately 3 am, Plaintiff was lawfully riding the F train on the way home from work in the vicinity of the 4th Street Subway Station. Without provocation, a woman unknown by Plaintiff started aggressively verbally harassing Plaintiff, who ignored the woman and tried to walk away from her. Without provocation, the woman physically attacked Plaintiff, striking him in the face and ear with a high heel shoe, causing a laceration to Plaintiff's ear and bleeding. Plaintiff feared for his life and safety and attempted to defend himself; there were numerous witnesses, at least one of whom filmed the woman attacking Plaintiff without provocation before Plaintiff attempted to defend himself. Description: Plaintiff got into a verbal argument with a woman who started attacking and assaulting him while on the subway. Defendant Officers arrived to the scene at a train stop and despite evidence that showed Plaintiff was the victim and not perpetrator of the attack, he was arrested and taken to a hospital and then precinct. Plaintiff was charged with Assault in the 3rd Degree and Disorderly Conduct, which were later dismissed.
