Description: On January 25, 2017, at approximately 9 pm, Plaintiff was lawfully in the vicinity of 255 East 188th Street, Bronx County when Defendants, NYPD officer Victor Yupa, Officer John Doe and officer John Roe without a warrant or reasonable cause approached Plaintiff and stopped, searched, grabbed, assaulted, battered, handcuffed and arrested Plaintiff in an aggressive and excessive manner. Description: Plaintiff and their friends were holding a celebration at the community garden. Police officers from the 46th Pct. who constantly harass them at the garden, rushed into the community garden, ordered people to lie on the ground, and then unlawfully searched and handcuffed them while other police officers destructively searched the garden. Although nothing illegal was found as a result of the police officers' unlawful search, the police officers nevertheless arrested Plaintiffs, took them to the 46th Precinct, unlawfully searched some of them, and falsely charged them with Disorderly Conduct. Charges were eventually dismissed.
