Description: On June 4, 2020, Plaintiffs were traveling in an automobile near the intersection of 8th Street and Avenue A in Manhattan, when Plaintiffs were stopped by Defendant Police Officers at a checkpoint. Plaintiff Wheeler (driver) presented his ID and, when requested, showed Officers the food delivery order information that he was delivering. Plaintiffs were initially allowed to proceed before being stopped by additional Defendant Officers who ordered Plaintiffs to exit the vehicle. Defendant Officers, including Officer Messina, slammed Plaintiff Wheeler headfirst into the rear windshield of his vehicle and handcuffed him.
