Description: On February 12, 2014, at approximately 9:00 p.m., Plaintiff was driving when a police vehicle from the 69th Precinct made a U-turn and approached his car from behind. Defendant Police Officer Melendez and an unidentified Asian male officer stopped Phillips, alleging that his high beams disturbed their vision. The officers then ran a check on Phillips and falsely claimed he had an outstanding warrant, which was actually issued for someone else. Despite informing the officers that he was a dialysis patient, Phillips was handcuffed behind his back, placed in a police cruiser, and transported to the 69th Precinct.
