Description: On November 13, 2016, Plaintiff Miguel Cruz purchased a pair of headphones from a Best buy near Times Square and carried the receipt and headphones in a shopping bag. Outside the store, he ignored the request of a homeless person for money and entered the Lids store. Defendant Officer Thomas Ketcham and one or more unidentified police officers approached Plaintiff, told him that the homeless man had accused plaintiff of stealing the headphones from him and that Plaintiff was carrying a gun, both of which were false.
