The protective order had expired and additionally Plaintiff would not have violated the protective order because the event was not held at the home, school, business of or place of employment of Benheim. Benheim alleged to police that Plaintiff glared at her while attending the dinner. Description: On or about January 22, 2017, at approximately 6:00 P.M., Plaintiff Frank Alston was visiting a friend when Defendant Officers Epstein Grullon and other unidentified officers unlawfully entered the property where Plaintiff was located, approached Plaintiff with loaded firearms, grabbed and restrained Plaintiff and handcuffed him, causing injury to his wrists. Defendants accused Plaintiff of having committed a crime and of trespassing on the premises, which Plaintiff denied and informed the Defendants he had permission to be there. Plaintiff was arrested and taken into custody at a Bronx police station where he was charged with certain crimes, and held for 21 hours before being released.
