Description: On or about January 24, 2013, Plaintiff was lawfully sitting in the driver's seat of his car with the engine off and no key in the ignition. A Defendant NYPD Police Officer asked Plaintiff to exit his vehicle, and with malice and without probable cause, accosted and accused Plaintiff of driving while intoxicated. The Defendant officer than conducted an unlawful search of Plaintiff's vehicle and without any justification, issued Plaintiff a summons for disorderly conduct. The summons was dismissed by the Court on April 10, 2013. As a result of the ordeal, Plaintiff suffered physical and emotional injuries.
