Description: On April 25, 2020 Plaintiff was in the vicinity of Kelly Street and East 163rd Street in the Bronx when Defendant Officers, including Officers Samuel and Rivera, approached Plaintiff for no reason, and stopped, searched, and detained him in an aggressive and excessive manner. Plaintiff was falsely arrested, remained incarcerated for over 24 hours, and was required to make numerous court appearances over an extended period of time until all charges against him were dismissed.

Description: On September 12, 2015, Delly Gomez was approached by NYPD Officer Stephen Samuel near his home at Kelly Avenue in the Bronx. Officer Samuel allegedly harassed Mr. Gomez, subjected him to unlawful searches, and falsely accused him of operating a vehicle while under the influence of alcohol, despite Mr. Gomez’s repeated denials and refusal to take a breathalyzer test. Officer Samuel allegedly handcuffed Mr. Gomez tightly, causing pain and swelling, ignored his complaints, and transported him to the precinct and hospital. Description: On May 23, 2015, at the 41st Police Precinct in the Bronx, Plaintiff needed to walk down a set of stairs. NYPD Officers Stephen Samuel and Michael Rubeis, as well as ten unidentified police officers and/or detectives, failed to offer Plaintiff assistance despite the fact that he was handcuffed and they knew he walked with braces and a cane. They then pushed and/or forced him down the stairs while he was handcuffed, causing him to suffer physical injury. They also failed to bring Plaintiff before a local criminal court within 24 hours. They also seized over $70,000 from inside Plaintiff’s apartment but vouchered only $36,158 and kept the rest for themselves.
