Description: On October 15, 2011, plaintiff John Dekuyper was participating in an Occupy Wall Street-related assembly in the Times Square Area in Manhattan alongside his wife and daughter. Plaintiff was separated from his wife and daughter at about 6:00 pm due to the police funneling protesters into a kettle in the vicinity of West 46th Street and 7th Avenue. Plaintiff was pressed against a metal barricade the police placed between themselves and the kettled protesters, while Defendant NYPD Chief of Department Joseph Esposito and other NYPD officers shoved, punched, and kicked protesters, and NYPD officers on horseback threatened to trample plaintiff and other protesters.
