Description: On December 12, 2012, at approximately 9:30 p.m., plaintiff Juan Garcia, a Hispanic American, was at Marcy Park, Brooklyn, when he was illegally stopped and questioned by the defendant NYPD officers, including Wadsen Jean Baptiste and John Dennis, pursuant to a practice of disproportionately stopping and questioning African-American and Hispanic-American individuals. Despite plaintiff not committing a crime or offense, the defendant officers arrested and transported him to a police precinct. The defendant officers created and used false evidence against plaintiff, leading to his detention and prosecution on false charges that he had violated park rules.
