Description: Plaintiff was walking out of the train station when he saw defendant officers trying to place a male into arrest and a female crying. The female looked at plaintiff and plaintiff said hey. Defendant officers tried to grab plaintiff's hands but failed. Plaintiff then told defendant officers to chill but defendant officers tried to grab plaintiff's hands and place him under arrests. Defendant officers also assaulted plaintiff in the process. Plaintiff was transported to Transit District 3 and was charged with resisting arrest, obstructing governmental administration in the second degree, and disorderly conduct. The charges were adjourned in contemplation of dismissal.

Description: On October 10, 2012 Plaintiff boarded the A-Train Subway when NYPD Officer Defendants Batista and Colangelo approached him and told him to get off. Plaintiff complied and walked off the train and proceeded to walk up the steps of the station. Plaintiff lost his step and fell down 12 steps. Defendants moved out of the way as Plaintiff fell. Plaintiff landed on his chest and was then handcuffed and arrested for two counts of assault in the second degree. Plaintiff was taken to the precinct and held for five hours. Defendants filed false reports of the event to the District Attorney. Defendant Batista lied about her claim stating Plaintiff had pushed her down the stairs, causing her to suffer injuries to her wrist...
