Description: On April 8th, 2014, Plaintiff was driving home with a friend. He was stopped by NYPD Officers Cumming and Sergeant Sandoval. They falsely accused him of a traffic infraction, harassed him, threw his identification at him. Plaintiff protested but did not resist. The officers then unlawfully dragged him out of the car and sprayed mace at him. Other officers arrived, used their asp on him, and dragged him along the road. He was then booked on fabricated charges.

Description: Plaintiff was pulled over after being followed by an unmarked police car with their emergency flash lights on. Defendant P.O. Rushtlion spoke to the plaintiff in a "negative, loud, hostile tone of voice". Plaintiff was told to exit his car and place his hands on the hood of the car. Rushtlion pulled the plaintiff's arm, dragged him by a chokehold, and body slammed the plaintiff onto his car. Defendants Sandoval and Olsen then searched the plaintiff's shirt and pants pockets. The plaintiff's request to call captain in regards to his illegal search and arrest was denied. The defendants also refused the plaintiff of his Miranda rights. Plaintiff was released on ROR.
