Description: On June 3, 2012, Plaintiff had just gotten into a car when NYPD officer Brian Fortune ordered Plaintiff out of the car, informing Plaintiff that he was under arrest. The officer accused Plaintiff of throwing rocks and breaking glass at a nearby restaurant. Plaintiff asked the officer to go back to the restaurant and check the cameras. The officer denied the request. Plaintiff was stopped, searched, seized and arrested without legal justification or basis. Plaintiff was brought to the precinct and then to central booking.
