Description: On November 17, 2021, plaintiff and two friends were in a car rented by their friend Piantini, who was not in the vehicle. In the vicinity of Fordham Road and University Avenue, they were stopped by defendant police officers, who directed the occupants to exit the car and informed them that the car was reported stolen. Plaintiff and his two friends explained to the officers that they had permission to be inside and operate the vehicle, and minutes later Piantini and the owner of the car also arrived at the scene to confirm the same. Description: On November 21, 2017, plaintiff was driving down the road, when his vehicle was stopped by defendant POs Martinez and Does without any probable cause. Defendant POs subsequently arrested the plaintiff accusing him of driving a stolen vehicle. Even after the owner of the car had informed defendant POs that plaintiff was lawfully leasing the car from him, they proceeded to falsely charge plaintiff with grand larceny, criminal possession of stolen property and unauthorised use of a vehicle. After numerous court appearances, the charges were dismissed upon application of the District Attorney.
