Description: On July 19, 2019, Plaintiff was arrested in his home by PO Derby Wancique, SGT Andrew Fitts, and LT Timot Hinterman on charges of Perjury in the 1st Degree, Offering a False Instrument for Filing with intent to defraud, and Official Misconduct. During the trial, ADAs Nick Viorst, Stephanie Minogue, Constantine Coritsidis, Samantha Dworken, and Timothy Heil repeatedly failed to turn over discovery items to the prosecution, and signed false certificates of compliance stating that they had turned over all materials. The case against Plaintiff was subsequently dismissed for the discovery violations.

Description: On or about September 25, 2019 Plaintiff Jimenez was falsely charged and arrested without probable cause for the sexual abuse of a minor. Despite lack of credible evidence where the minor child admitted to lying, two staff of the Administration for Children Services also brought Article 10 petitions in Family Court against him for engaging the welfare of his own minor children. The charges were dismissed after a two day department trial. The Article 10 petitions were dismissed. When Plaintiff Jimenez reported the false arrest and malicious prosecution to the New York Daily News and New York Post, Police Commissioner Shea terminated Plaintiff's employment.

Description: On or about September 4, 2012, unnamed defendant officers (which may include, but are not limited to, defendants PO Winston Babolal, PO Derby Wancique, and Sergeant Eric Panni) arrested plaintiff, a Black man, in his home without cause and charged plaintiff with robbery in the 2nd degree, among other charges. Plaintiff did not steal any property or commit any offenses under city or state laws that would support his arrest. Defendant officers tightly handcuffed plaintiff behind his back, pushed him into their police cruiser, and detained him at the NYPD's 81st precinct for an extended period.
