Description: On April 8, 2014, at approximately 12:20 p.m., Plaintiff was shopping in the Costco Store located at 976 Third Avenue in Brooklyn. Plaintiff purchased and paid for several items totaling $718. A “Loss Prevention Agent” working at Costco prevented Plaintiff from leaving the store, accused him of shoplifting, and detained him in the Costco detention area. Costco engages in a pattern and practice of profiling African American shoppers as suspected criminals. Despite showing the Costco employee and NYPD Officer Jorge Santacruz his receipt, he was searched and arrested without probable cause and taken to the 72nd Police Precinct.
