Description: On December 17, 2019, Plaintiff was lawfully present as a pedestrian on the sidewalk after finishing a health appointment. At that time, Plaintiff was smoking a cigarette when he was approached by Defendants, including Balena, An, and Bradshaw, who illegally approached and stopped Plaintiff. Defendant Officers then grabbed the cigarette from Plaintiff’s hands without asking. Defendants then demanded and took Plaintiff’s identification, went to their police vehicle, returned, and accused Plaintiff of a criminal offense without reasonable suspicion or probable cause.
