Description: On January 28th, 2021, Plaintiff was lawfully in his apartment located in a hotel that was then converted into a shelter used to house the homeless. NYPD Officers (Detective Albert Vitarelli, and others (listed in the case as PO John and Jane Doe 1-10)) along with a resident assistant, of the hotel, entered Plaintiffs's apartment. Plaintiff was taken to the 1st precinct where he was interrogated by the aforementioned officers. The officers charged plaintiff with two counts of burglary. Following the charges, plaintiff spent 24 hours in custody before facing a judge where he became privy to the charges being alleged against him.
